1. Does a Seal Registration Certificate Have an Expiration Date?

  1. In principle, a Seal Registration Certificate issued by a household registration authority does not have a fixed expiration date. In practice, however, its validity depends on the authority or institution requiring its use.
  2. According to Point 4, Paragraph 2 of the Directions for Household Registration Offices Handling Seal Registration: “For a Seal Registration Certificate issued by a household registration office within the valid period, its period of use and legal effect shall be reviewed and determined by the authority or institution requiring its use.”
  3. For land administration authorities, the accepted Seal Registration Certificate is limited to one issued within one year before the date on which the registration cause occurred. Article 41, Paragraph 10 of the Land Registration Regulations provides: “The party’s Seal Registration Certificate issued within one year before the date on which the registration cause occurred shall be attached.”
  4. If the certificate is not being used with a land administration authority, its validity period must still be determined by the authority or institution requiring it.
  5. For inheritance procedures handled by financial institutions or securities companies, it is generally valid within three months.
  6. For applications to the court for waiver of inheritance or limited inheritance, including filing an estate inventory, it is generally valid within three months.
  7. The validity period is calculated from the issuance date of the Seal Registration Certificate, as shown in the red box in the image below.

 

2. What Is a Seal Registration Certificate?

  1. A Seal Registration Certificate is an official document issued by a household registration office and carries public credibility.
  2. Many government agencies can access the household registration office system through designated channels to verify the party’s seal registration information.
  3. When a Registered Seal is affixed to an important document together with a Seal Registration Certificate, it can represent the person’s own act. This is different from using an ordinary personal stamp.
     

3. When Is a Seal Registration Certificate Needed?

  1. When the person cannot conveniently appear in person for identity verification and appoints an agent to handle legal matters.
  2. When the signed document is highly important and the authority or institution requiring it needs to confirm, through the Seal Registration Certificate, that the document reflects the person’s true intent.
     

4. How Is a Seal Registration Certificate Verified?

  1. After the Registered Seal is affixed to an important document and the Seal Registration Certificate is attached, the authority or institution requiring it can compare the seal impression on the document with the seal impression on the certificate to determine whether the legal act was carried out by the person.
  2. If the Seal Registration Certificate states an “application purpose,” the authority or institution requiring it will also determine whether that purpose matches the legal act asserted in the document.
 

5. What Are the Uses of a Seal Registration Certificate?

When applying for a Seal Registration Certificate, the purpose of use must be stated in the application field. Common purposes include the following six categories:
Real Estate-Related Procedures
  • Registration matters involving the sale, gift transfer, inheritance, or trust of houses and land.
  • Registration of creation, cancellation, or amendment of real property mortgages.
  • Advance notice registration.
Legal and Court Matters
  • Used for court notarization or deposit procedures.
  • Matters related to applying for waiver of inheritance or limited inheritance, including filing an estate inventory.
Financial and Asset Inheritance
  • After a depositor of a financial institution dies, the heirs handle inheritance of the deposit.
  • After the lessee of a bank safe deposit box dies, the heirs apply for the relevant inheritance procedures.
Compensation and Transactions
  • Compensation for land readjustment or zone expropriation.
  • Registration of creation of secured transactions in personal property.
Fishing Vessel and Ship Matters
  • Transfer of eligibility for fishing vessel replacement.
  • Ship registration, secured transactions, mortgage registration, and related matters.
Other Unrestricted Uses
  • When there are no specific restrictions, it may be used as a legally valid identity verification document.
